Merry Truckmas - Win $2,000 in Weekly Prizes

The Promotion is conducted by Isuzu Australia Limited (ABN 97 006 962 572) of 66 Foundation Road, Truganina, Victoria 3029 (Promoter).

These terms and conditions of entry (Terms and Conditions) apply to the Promotion and by submitting an entry to the Promotion, an entrant agrees to and will be bound by these Terms and Conditions.

Who is eligible?

1.1 Entry for the Promotion is open to all individuals who meet the following criteria (Eligibility Criteria):

(a) entrants must be an Australian resident aged 18 years and over at the time of entering the Promotion;

(b) entrants must have an email address;

(c) entrants must complete the entry form in full, providing all required information; and

(d) entrants must not otherwise be ineligible under these Terms and Conditions.

(e) entrants must have an active Australian Business Number (ABN)

1.2 The Promoters’ immediate family members of employees, and employees of any other company, supplier or agency associated with the Promotion are ineligible to enter. Any other person who assists in determining the winner of the Promotion is ineligible to enter.

1.3 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, and place of residence).

1.4 The Promoter may disqualify an entrant who:

(a) tampers with the entry process;

(b) submits an entry that is not in accordance with these Terms and Conditions; or

(c) has, in the opinion of the Promoter, engaged in conduct in entering the Promotion, which is fraudulent, misleading, deceptive, illegal or generally damaging to the goodwill or reputation of the Promotion and/or the Promoter.

1.5 The Promoter's legal rights to recover damages or other compensation from an entrant are reserved.

1.6 Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of its rights.

How to enter the Promotion?

2.1 The promotion commences at 0:00am (AEDT) on 8 November 2023 and ends at 24:00pm (AEDT) on 24 December 2023 (Promotion Period), after which no further entries will be accepted.

2.2 Entry to the Promotion is via an online form located at URL: https://www.isuzu.com.au/merry-truckmas (Page). You will be required to complete the details on the form including an open text response to the Competition Question:  In 50 words or less, what do you want for Christmas and why?

2.3 Provided you meet the Eligibility Criteria, you must follow the instructions to complete the form in full, including providing all required information, and submit the form in the manner directed in order to enter the Promotion.

2.4 The Promoter will consider entries to be accepted at the time of receipt of the form, and not at the time of submission.

2.5 Only one entry per person to the Promotion is permitted.

2.6 Any late, lost or misdirected entries or incomplete, indecipherable or illegible entries will be deemed invalid.

How do you win?

3.1 The Promotion is a game of skill.  Valid entry submissions will be judged at the Promotor’s premises by a panel of three judges selected by the Promotor.  The judges will decide which entry provides the best and most original answer to the Competition Question for the relevant week.  There will be seven winners in total to be decided each Monday for a period of seven weeks commencing on Monday 13 November.

3.2 The Promoter’s decision in relation to any aspect of the Promotion is final and binding on every participant who enters the Promotion.

3.3 The Promoter is not required to provide any information or correspondence to any participant who enters the Promotion regarding the selection criteria or reasons for their decision.  Additionally, unsuccessful entrants will not receive any correspondence.

3.4 The selected winners will be notified by telephone and email within 24 hours of the decision being for each week and will be asked to select their Price Pack preference (see below).  The winner’s names, business and state will be published (declared) on the Promotor’s website (www.isuzu.com.au/merrytruckmas) and promotional emails and social media posts.  By participating in the Promotion, the winners agree to publication of their details.

3.5 The Promoter reserves the right to require each winner to provide proof of identity satisfactory to the Promoter (in their sole discretion) before awarding the Prize.

What is the prize?

4.1Winning Eligible Entrants are entitled to the following Prize Pack from the Promotor:

• 1 x $1,000 (Inc GST) Caltex StarCash Prepaid Fuel Card (use of which is subject to further terms and conditions of Caltex – these are available at http://www.vaultps.com.au/terms-conditions/)
• Plus one choice from the following options:

i.$1,000 (Inc GST) single transaction credit towards Isuzu Parts & Accessories from an Isuzu Trucks Dealer or

ii.$1,000 (Inc GST) single transaction credit towards Truck Servicing (or Isuzu Service Agreement) at an Isuzu Truck Dealer

The total prize value for the Promotion is $14,000 (Inc GST)

4.1 The Prize Pack, or any unused portion of the Prize Pack, is not transferrable or exchangeable and cannot be taken as cash.  The Prize Pack will be emailed to each winner within 30 days of the winner being declared.

4.2 Each winner must comply with all reasonable directions or instructions of the Promoter in order to receive the Prize. The use of the $1,000 Isuzu Parts and Accessories or Servicing Credit must be claimed during one transaction at a participating Isuzu Truck Dealer. If a Prize Pack remains unclaimed for a period of 30 days or the winner is unable to accept the Prize Pack for any reason, the Promotor reserves the right to select or award a new winner.

Liability

5.1 To the extent permitted by law, the Promoter excludes all guarantees, warranties, conditions or other terms that apply under or are implied by statute, common law or trade custom or usage.

5.2 If in the conduct of this Promotion the Promoter is liable for a breach of any guarantee, warranty, condition or other term that applies under the Australian Consumer Law or is implied by any other Commonwealth, state or territory law that cannot be excluded, the Promoter’s liability under that legislation is limited, to the extent permitted by law, to (a) the replacement of the goods or the supply of equivalent goods; or (b) the resupply of the services.

5.3 Subject to clause 5.2, to the extent permitted by law, the Promoter (including its officers, employees, related companies and agents) excludes all liability to the prize winners, entrants or anyone else for any injury, personal injury, damages, expenses or loss whatsoever (including without limitation loss of profit, revenue or business and indirect, consequential, special or incidental loss or damage), sustained in the course of the Promotion and accepting or using a Prize Pack.

5.4 If for any reason the Promotion is not capable of running the Promotion as planned, including, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, or to cancel, terminate, modify or suspend the Promotion subject to any direction given under applicable Australian law.

Privacy

6.1 The Promoter will collect, hold and use the personal information provided by an entrant for the purpose of conducting the Promotion, including providing any Prize to an entrant. If you enter this Promotion, your personal information may also be disclosed to the relevant government department or otherwise published, as required by Australian law. 

6.2 If an entrant does not provide the requested personal information, the Promoter will not be able to accept an entry as being a valid entry in the Promotion or allow an entrant to participate in the Promotion.

6.3 By participating in the promotion, each entrant consents to the Promoter using, and disclosing their personal information to the Promoter's related entities, agencies and other third parties engaged to provide services in connection with the Promotion, for the purpose of contacting the entrant in relation to the Promotion and promoting the winner. The Promoter otherwise will handle an entrant’s personal information in accordance with its Privacy Policy available at https://www.isuzu.com.au/privacy-policy/ and the Collection Notice which appears https://www.isuzu.com.au/merry-truckmas 

Isuzu Australia Limited (IAL) collects personal information about entrants to include entrants in the promotion and where appropriate award Prizes. If the personal information requested is not provided, entries will be deemed invalid. By participating in the Promotion, you consent to us using, and disclosing your personal information to our related entities, agencies and other third parties engaged to provide services in connection with the Promotion, to contact the entrant about the Promotion and promote the winner. 

By participating in the promotion, you also consent to IAL using your personal information for promotional, marketing, publicity, research and profiling purposes. We use the services of certain third-party service providers (including Meta and Google) which may have offices or other operations outside of Australia. As a result, your personal information may be disclosed to overseas recipients.  IAL’s privacy policy contains information about how you may access your personal information and seek correction of such information; as well as how to complain about a breach of the Australian Privacy Principles and how we will deal with such a complaint. Any ancillary costs associated with redeeming the Caltex Pays-enabled Prepaid Gift Card (“the Card”) are not included. The Card must be activated within 2 months of issue and is valid for 12 months after activation. At expiry of the Card any unused balance will be forfeited. Eligible Customers will not receive notice prior to expiry. Card expiry and balance can be found on your mobile device in their digital wallet.
